INSURANCE CLASS ACTIONS
Leverty & Associatesis was class counsel for a certified national class action providing benefits to class members throughout the 50 states. The certified national class action of Pak v. Farmers Insurance Exchange resulted in potential award to class members of $48 million. Few, if any, Nevada law firms have this unique experience of certifying a nationwide class action.
Why a class action? This unique joinder of individual claims is a procedural mechanism that allows multiple claims to be tried at the same time allowing for greater economy of scales. It also allows for the litigation of issues and individual rights that would normally never be seen in court.
A class action is a useful and effective procedural device used to rectify alleged wrongdoings caused to a large number of individuals and/or entities where the damages individually are insufficient to support the cost of bringing individual claims or the repeated litigation of the alleged wrongdoing is deemed excessively costly and time consuming dictating that the most effective manner to bring and/or to resolve the entire matter is the use of a class action. Defendants often refer to the resolution of a class action as placing a cap on their liability to permit them to get back to conducting their business.
