LITIGATION

This firm has vast experience representing consumers/policyholders in asserting their rights against insurance companies. We have represented insurers and insureds in high profile bad faith litigation with great success. Such representation includes insurance bad faith and violations of Nevada's Unfair Claims Practices (pdf).

Although much of our litigation work is in the State of Nevada, we increasingly represent clients in courts and before administrative agencies outside of Nevada. Currently our firm has members licensed to practice in the states of California and Washington, in addition to Nevada. Specifically, Leverty & Associates has experience in litigation brought under California's Unfair Competition Law, Business and Professions Code Section 17200 et seq. Gene Leverty lectured at a California Insurance Law Seminar in 2002 (pdf).

We are adept at trying cases at both the trial and appellate levels, and in Nevada state and administrative courts, California state courts, and United States Federal Courts.

We believe the fact that we represent insurance companies as well as insureds enables us to provide insight and perspective to our clients in their cases, as well as how to avoid litigation. We are very experienced in high-powered paper wars, which are prevalent in bad faith and class action lawsuits. We emphasize an aggressive motion and discovery practice. These practices translate into success in the courtroom, where we have a proven record of success.

This firm has successfully defended insurers in cases alleging millions of dollars in damages, as well as having obtained multi-million dollar jury verdicts on behalf of insureds (pdf). For these successes Gene Leverty has earned a membership in the Million Dollar Advocate Forum.

This firm also recognizes that the best result for our clients might be garnered through settlement. This firm has considerable experience in mediation and arbitration. We are committed to use alternative dispute resolution where appropriate, and have had great success achieving multi-million dollar settlements through settlement.
